Hawkwind reserve the
right to change these rules at any time and without prior
notice, any "Major alteration" will be publicised via this
web site, our Myspace page and the official forum.
HAWKWIND
RECORDING AND TRADING POLICY
Hawkwind allows audience audio taping at almost
every live performance. Soundboard patches will not be
allowed. As per our previous message it's Hawkwind's
intention to release one show from each tour, we'll attempt
to advise you in advance and that show will have a taping
ban for obvious reasons
Taping is a privilege granted by the band to their fans. By
respecting the following guidelines you can help the band
extend the privilege of taping for many years to come.
When Hawkwind is performing at a festival or other event
featuring multiple bands, that particular event's policy may
override Hawkwind's customary taping policy. When and if
Hawkwind are opening for another artist, that particular
artist’s policy may override Hawkwind's taping policy. Under
certain circumstances we may not allow taping and or
duplication of a specific show due to the potential
commercial distribution of that performance.
All taping is limited to audio only - no video or flash
photography is ever allowed (see note below regarding camera
phones) . Hawkwind are not in a position to offer AC power
to any tapers. Tapers must bring, and are responsible, for
all of their own equipment. Home decks and large mixers are
not allowed. Please give the working crew/soundman plenty of
room and do not set up equipment in a way that would impair
them to do their job properly.
However it seems
like half the audience at any gig these days (not just
Hawkwind) seem to view the show through the lens of their
camera phone and are filming clips. I think all would agree
that's it's nigh on impossible to police this so Hawkwind's
view is that clips of a "watchable and listenable" quality
may be posted to sites such as you tube as long as they show
the band in a good and positive light. All the rules listed
here apply to this media as well and Hawkwind reserve the
right to ask for any clip to be removed from any such site
for any reason regardless of quality.
The enjoyment of the audience in attendance at a concert
always takes precedence over recording efforts. This means
that at no time should tapers ever require other patrons to
be quiet or otherwise interfere with their enjoyment of the
show.
Please also note
We cannot and will
not overrule individual venues policy as far as taping is
concerned. It's the individuals responsibility to find this
out and Hawkwind will on no account be held responsible for
actions and any possible legal proceedings by a venue or
someone associated with a venue resulting from any audience
member attempting to tape a show
DUPLICATION/TRADING
The trading and distribution of all audience
recordings of Hawkwind concerts is allowed.
With the following
exceptions
Hawkfest 2 - 2003
Roadburn - 2006
All shows after 2012
(so 2013, 2014 and 2015)
Until advised otherwise
All participants in audio recording exchange (regardless of
format) acknowledge and respect the copyrights and exclusive
ownership of the music and performances by the performers,
writers and publishers.
All taping must be for personal use only, which may include
trading (via analogue or digital tape, CD, or digital file
transfer). Recordings may be traded freely on a strictly
not-for-profit basis (no money is to change hands) and may
be traded only for an equivalent amount of similar media.
In addition, the media by which audio trading is publicized
may not be commercialized. Therefore no commercial gain may
be sought by websites offering digital files of our music,
whether through advertising, offer links for compensation,
exploiting databases compiled from their traffic, or by any
other means.
If we have chosen to offer for sale a particular Hawkwind
performance, this "official" version will take precedence
over other recordings and said recordings should
no longer be traded, or made available by
websites, servers, or other means. In no case may any
officially-released Hawkwind recording (live or studio) be
duplicated or otherwise traded or offered.
Taping at Hawkwind concerts is authorized for non-commercial
purposes only. Unauthorized sale, duplication and/or
distribution is strictly forbidden. All Hawkwind
performances, recordings and copyrights are the exclusive property of Hawkwind. We reserve the right to withdraw our sanction of
recording, tape trading, and/or non-commercial digital audio
file transfers
on a case specific basis or in general, as we deem
necessary. If you are aware of any person or site in
violation of this policy, please inform us by contacting us
at.

Lastly, please support the artists you tape and trade by
purchasing the merchandise that keeps Hawkwind on the road
(CD’s, T-shirts etc.).
TORRENT SITES
As long as all
rules are adhered to Hawkwind has no objection to fans
obtaining recordings that meet the criteria set out above.
DISCLAIMER
Hawkwind cannot and
do not give permission to anyone to infringe the rights of
any third parties including performers, writers or
publishers. Everyone must take responsibility themselves to
get any necessary permissions from the owners of the rights.
Hawkwind can only give permission for their own performances
and this is subject to the above conditions.
Hawkwind will not indemnify anyone from any action taken by
any third parties or ex band members.
